What it does: The MIND Act addresses neural data—information capable of revealing a person's mental state or activity. The bill would require the Federal Trade Commission to study how neural data is collected, used, stored, sold, and protected, and recommend whether additional federal safeguards are needed. It would also require federal guidance governing agency use of neurotechnology that collects or processes neural data, including safeguards, transparency requirements, consent mechanisms, and privacy protections.
Potential impact: The proposal could help establish the foundation for federal rules governing some of the most sensitive information technology may eventually collect: information generated by the brain and nervous system. For the scenario explored in "Thought Turmoil", however, an important limitation remains. The bill would begin a federal study and rule-development process; it does not itself establish a warrant requirement or comprehensive prohibition on law-enforcement access to private cognitive activity.
